“No Courts, No Justice, No Freedom” is the ABA’s national theme for Law Day. And this year, there is special urgency in Florida to help educate citizens not only about the importance of maintaining a fully funded court system, but to ensure that the judiciary remains independent and free of political attacks.
Plea waivers under examination
The Professional Ethics Committee has postponed its vote on a proposed advisory opinion that would make it unethical for defense attorneys to advise clients to waive future claims of ineffective assistance of counsel as part of the plea bargaining process. The opinion would also make it unethical for prosecutors to require a defendant to waive any future claim of prosecutorial misconduct.
Facing devastating cuts to legal aid, Foundation turns to lawyers
Florida Bar President Scott Hawkins and Florida Bar Foundation President Michele Kane Cummings have issued a joint appeal to lawyers for charitable donations to the Foundation to help minimize funding cuts local legal aid programs will experience in the next three years due to declining revenue from Florida’s Interest on Trust Accounts Program.

The current economic climate is a drag on law firms’ profitability, and a majority of Florida lawyers don’t expect the economy to recover for at least another two years. This according to the conclusions drawn from a survey conducted by the Bar’s Research, Planning and Evaluation Department
JUSTICE FRED LEWIS recently presented an interactive Justice Teaching presentation to the Law Academy of Alonso and Tracy Mourning High School at the North Dade Justice Center as part of the Color of Justice program sponsored by the National Association of Women Judges. . .

Whether Ranches Dedicated to Abused, Abandoned, and Aging Horses Qualify for “Agricultural” Classifications Under Florida’s Greenbelt Law In light of recent special sessions, hiring freezes, lagging real estate markets, and numerous articles on greenbelt abuse, local governments need a legal adaptation to help ease the tensions between property owners and property appraisers. Despite tensions over property values, Florida’s population continues to grow steadily, including Florida’s equestrian community. Florida boasts the third largest horse population in the country, surpassed only by California and Texas. With an economic impact on gross domestic product of over 6.5 billion dollars, and generating over 72,000 jobs, the Florida equestrian industry is a significant agricultural commodity. |

Comparing this fall’s merit retention elections with an attorney’s responsibility to revere the law in both public and private, Bar President-elect designate Gene Pettis encouraged attendees at the Young Lawyers Division Affiliate Outreach Conference to educate voters in their communities on the role the judiciary plays in state and federal government.
